Obama appeals - demands unrestricted detentions
Obama's steady and relentless assault against civil liberties --The White House has asked the US Second Circuit Court of Appeals to place an emergency stay on a ruling made last week by a federal judge so that the president's power to indefinitely detain Americans without charge is reaffirmed immediately. -- On Wednesday, September 12, US District Court Judge Katherine Forrest made permanent a temporary injunction she issued in May that bars the federal government from abiding by the indefinite detention provision in the National Defense Authorization Act for Fiscal Year 2012, or NDAA. Judge Forrest ruled that a clause that gives the government the power to arrest US citizens suspected of maintaining alliances with terrorists and hold them without due process violated the Constitution and that the White House would be stripped of that ability immediately. Obama's NDAA Law Allowing Indefinite Military Detention of Citizens Ruled Unconstitutional. The Obama administration's efforts to enshrine sweeping 9/11-era rollbacks of civil liberties and constitutional rights as federal law hit a serious roadblock yesterday, as a federal judge struck down clauses of the National Defense Authorization Act as unconstitutional. -- The offending section of the NDAA, signed by Obama on New Year's Eve last year, grants the government the power to put citizens in military detention indefinitely and without the usual recourse to civil courts. -- Chris Hedges, along with other writers and activists including Daniel Ellsberg and Noam Chomsky, challenged the law soon after in a federal lawsuit, arguing it is so broad that it infringes on their own first-amendment rights.

Proposition 34 offers a reasonable way to end the death penalty and replace it with life in prison without the possibility of parole, taking prisoners off death row and requiring them to work and provide restitution to the families of their victims. Gay Marriage may come soon in California!

Within as little as two weeks, we may know whether The American Foundation for Equal Rights case challenging Prop. 8 will be heard by the U.S. Supreme Court. If the Justices decide not to hear this case, marriage equality will be restored in California. Regardless of what the U.S. Supreme Court decides to do, Prop. 8 is hanging by a thread. If the U.S. Supreme Court decides to hear the case for marriage equality, the announcement can come as early as September 25.

FOR TOO many years, public school teachers and their unions have had to endure a bipartisan attack on their rights, their working conditions, even their competence and commitment--all in the name of what's supposedly "best for the children." -- In Chicago this week, teachers have taken a stand for what's really best for children--fully funded public schools and qualified, well-compensated educators to teach them. The 26,000 members of the Chicago Teachers Union (CTU) are saying "no" to the smears against educators, "no" to the neglect of public schools, "no" to transforming education into a business venture.

'Sunshine' vitamin D may aid in treatment of TB

Now, a new study shows that the "sunshine" vitamin - vitamin D - may help speed up the recovery of tuberculosis patients. -- Before antibiotics were readily available, doctors would to send their patients to receive heliotherapy - basically prescribed sunbathing. The practice was stopped since more effective antibiotics were invented, but physicians have often wondered why the sunshine treatment seemed to somewhat work.

Why San Onofre Should Never be restarted


"If Edison tries to restart a reactor that is heavily damaged without having fixed the underlying problems, it places us all at risk," said UC Santa Cruz professor Daniel Hirsch. -- San Onofre's two active reactors were both shut down in January. One was shut down for planned repairs while the other was shut down abruptly on Jan. 31, when a faulty piece of equipment leaked a small amount of radioactive steam. The leak led to the discovery that many more cooling tubes were wearing out more quickly than expected. The plant has been offline ever since. San Diego: False arrest while registering voters

Ray Lutz filed suit on Sept. 13, 2012, for a false arrest which occurred on November 29, 2011, while Lutz was in the middle of registering voters in San Diego's Civic Center Plaza, well known as the town square of San Diego. The suit named three defendants explicily: a) the City of San Diego, b) Police officer Tony Lessa, who arrested Lutz, and c) CBRE, "CB Richard Ellis Group" that manages the Civic Center Plaza Office Building and that performed a citizen's arrest for trespassing. The Supreme Court has ruled that the public has the right to use privately owned malls for peaceful political activity, such as gathering signatures or handing out political literature, with time, place, and manner restrictions.

Jennifer Granholm sets Dem Convention on fire


Granholm energized the delegates at the Democratic National Convention Thursday evening with a sharp-tongued speech about President Obama's decision to bail out automakers General Motors and Chrysler and Mitt Romney's opposition to the plan. -- Granholm, now a Current TV host, ripped into Romney's California home redesign, saying, "Siure, Mitt Romney loves our lakes and trees. He loves our cars so much, they have their own elevator. But the people who design, build, and sell those cars? Well, in Romney's world, the cars get the elevator; the workers get the shaft." -- Fist-pumping her arms and waving them over her head.

Obama won a law giving women equal pay


I was really captivated by this speech by Lilly Ledbetter at the DNC Convention in Charlotte. She is the real thing: A tough, determined woman with a hard Alabama accent. Her message is true Southern Grit(s) with red eye gravy. She brought the house down! And she rounded up many thousands of new women voters with this speech. President Obama knows that women being paid 77 cents on the dollar for doing the same work as men isn't just unfair, it hurts families. -- So the first law he signed was the Lilly Ledbetter Fair Pay Act to help ensure that women are paid the same as men for doing the exact same work.

34 South African miners gunned down by police


World's Richest Woman Wants Africans To Work for $2 A Day - By Thom Hartman - An Australian, Gina Rinehart, worth about $18 billion, states that in order to remain competitive with African miners, Australian must cut its miners wages to $2 a day. Video shows 34 unarmed South African miners on strike for higher pay, being mowed down by police in the worst slaughter since the end of apartheid.

Israeli soldiers abuse Palestinian children


"HUMAN SHIELD", Israeli veterans, have spoken out, describing a degrading culture of abuse and harassment of Palestinian children in the West Bank and Gaza by Israeli soldiers. A report containing 30 veterans' testimonies details numerous cases of violence committed by Israeli soldiers. - The report was released to world media on Saturday by Breaking the Silence, an organization made up of Israeli army veterans formed in 2004. They compiled more than 850 accounts from current and former Israeli soldiers describing abuses they committed or witnessed. - The investigation seeks to serve as "a witness to the ongoing decline of the military system into increasing immorality." - "The words of the soldiers included here constitute an urgent call to Israeli society and its leaders: We must foster a serious discourse regarding the price of military rule of the Occupied Territories," said the report.

50 years ago, JFK forced integration of Ole Miss

Fifty years ago James Meredith became the first black man to be admitted into the University of Mississippi (Ole Miss). October 1, 1962. Robert Kennedy called in 500 U.S. Marshals to take control, who were supported by the 70th Army Engineer Combat Battalion from Ft Campbell, Kentucky. They created a tent camp and kitchen for the US Marshals. To bolster law enforcement, President John F. Kennedy sent in U.S. Army military police from the 503rd Military Police Battalion, and called in troops from the Mississippi Army National Guard and the U.S. Border Patrol as well. In the violent clash, two people died, including the French journalist Paul Guihard on assignment for the London Daily Sketch. He was found dead behind the Lyceum building with a gunshot wound to the back. One hundred-sixty US Marshals, one-third of the group, were injured in the melee, and 40 soldiers and National Guardsmen were wounded.

Police pepper spraying and arresting students at UC Davis - In this video, now gone viral nationwide, a group of college students are huddled on the ground in a defensive position at UC Davis on November 18. UC police Lt. John Pike, then casually douses them with a chemical agent. Bystanders who were simply watching what was going on are also exposed. - If the police had legal grounds to make arrests, it seems apparent from the video that little or no force was necessary to achieve that goal. The students are obviously not a threat to the officers. It appears that the heavily armored riot police could have simply grabbed them and put them in flexi-cuffs had they chosen to do so. That means that this entire assault appears to be a perfect example of excessive force.
